(1) Ist das Vertragsverh\u00e4ltnis auf unbestimmte Zeit eingegangen, so kann es im ersten Jahr der Vertragsdauer mit einer Frist von einem Monat, im zweiten Jahr mit einer Frist von zwei Monaten und im dritten bis f\u00fcnften Jahr mit einer Frist von drei Monaten gek\u00fcndigt werden. Nach einer Vertragsdauer von f\u00fcnf Jahren kann das Vertragsverh\u00e4ltnis mit einer Frist von sechs Monaten gek\u00fcndigt werden. Die K\u00fcndigung ist nur f\u00fcr den Schlu\u00df eines Kalendermonats zul\u00e4ssig, sofern keine abweichende Vereinbarung getroffen ist.<\/p>\n
(2) Die K\u00fcndigungsfristen nach Absatz 1 Satz 1 und 2 k\u00f6nnen durch Vereinbarung verl\u00e4ngert werden; die Frist darf f\u00fcr den Unternehmer nicht k\u00fcrzer sein als f\u00fcr den Handelsvertreter. Bei Vereinbarung einer k\u00fcrzeren Frist f\u00fcr den Unternehmer gilt die f\u00fcr den Handelsvertreter vereinbarte Frist.<\/p>\n
(3) Ein f\u00fcr eine bestimmte Zeit eingegangenes Vertragsverh\u00e4ltnis, das nach Ablauf der vereinbarten Laufzeit von beiden Teilen fortgesetzt wird, gilt als auf unbestimmte Zeit verl\u00e4ngert. F\u00fcr die Bestimmung der K\u00fcndigungsfristen nach Absatz 1 Satz 1 und 2 ist die Gesamtdauer des Vertragsverh\u00e4ltnisses ma\u00dfgeblich.<\/p>\n
(3): A contractual relationship entered into for a certain period of time, which is continued by both parties after the agreed term has expired, is considered to be extended for an indefinite period of time. For the determination of the notice period according to paragraph 1 sentences 1 and 2, the total duration of the contractual relationship is decisive.<\/p>\n
Statutory Provisions (Article 89b German Commercial Code)<\/strong><\/p>\n The relationship between the commercial agent and his principal is governed by articles 84 – 92c HGB (German Commercial Code).
